Conflicto de competencia suscitado entre el Juzgado Promiscuo del Circuito de Paz de Ariporo y el Tribunal Administrativo de Casanare, en torno al trámite de la acción de tutela de la referencia.
La Sala Plena, considerando que la controversia presentada por los despachos judiciales precitados está amparada únicamente en las reglas de reparto del Decreto 1382 de 2000, advierte que en el presente caso no se existe ni siquiera un conflicto aparente de competencias y que el conocimiento de solicitud de amparo deber ser asumido por la autoridad a quien primero fue repartida, esto es, el Tribunal Administrativo de Canasare, a quien se dispone remitir el expediente para que, de forma inmediata tramite y resuelva la acción de tutela formulada.

- PRIMERO. DEJAR SIN EFECTOS el auto del 26 de noviembre de 2015 proferido por el Tribunal Administrativo de Casanare, dentro del expediente ICC-2361.
- SEGUNDO. ORDENAR la remisión del expediente ICC-2361 al Tribunal Administrativo de Casanare, para que, de manera inmediata, tramite y adopte la decisión de fondo a que haya lugar, dentro de la acción de tutela presentada por la señora María Hortensia Sarmiento contra la Caja Promotora de Vivienda Militar y de Policía.
- TERCERO. ORDENAR que, por Secretaría General, se comunique la decisión adoptada a las partes y al Juzgado Promiscuo del Circuito de Paz de Ariporo.
